The later date belongs to particular product entries

Specified products added by Delegated Regulation (EU) 2026/2102 have an express application date of 30 December 2027 in Annex I. Examples include frozen cattle tongues, coffee extracts and certain palm-derived goods. That date is a product-specific rule. It does not postpone EUDR for entire cattle, coffee or palm supply chains, nor create a general additional year for every business buying those commodities.

Use the EUDR implementation timetable to distinguish the three main routes. The general date is 30 December 2026, Article 38(3) provides a conditional June 2027 route for specified operators, and particular Annex entries expressly defer their provisions until December 2027. The correct calendar follows the actual product and applicable legal conditions.

Separate the amendment's legal existence from application

The scope amendment was adopted on 13 July 2026 and published on 17 September 2026. Its entry into force made the amended framework part of current law; it did not make the expressly deferred provisions apply to transactions immediately. The September 2026 consolidation therefore contains product entries whose application still lies in the future.

A product register should preserve that distinction. Record the current Annex wording, the express application statement and the verification date. Avoid a binary field that labels an item simply covered or exempt without timing. Before December 2027, an expressly deferred entry and an item entirely outside Annex I are different legal situations, even if neither currently triggers the same operational process.

December 2027 does not replace the operator timetable

The June 2027 route concerns operators satisfying Article 38(3), including its establishment condition and EUTR product exception. The December 2027 wording concerns specified Annex entries. A small-business label does not create the latter date, and the product-specific deferral should not be mistaken for permission to postpone already-covered goods that the same company supplies.

For example, an established small operator may have one product assessed under Article 38(3) and another matching an expressly deferred new entry. Those products require separate calendar records. Likewise, a medium operator's already-covered products generally follow December 2026 even where its newly listed product follows December 2027. Document the legal basis beside each conclusion so staff can see why the dates differ.

Build a mixed-product portfolio calendar

Consider a coffee business supplying goods under the existing 0901 entry and extracts under the newly added 2101 11 00 entry. The new extract provision's date does not delay the existing coffee entry. The business needs to assess the actual classification of each item rather than assigning one EUDR date to the entire coffee department.

The same principle applies where a palm supplier handles already-covered oils and newly listed derivatives. Marketing names and common feedstocks do not settle the timing. Keep the product specification, relevant entry and date together, and flag unresolved classifications. The 2026 changes overview distinguishes additions from clarifications, exclusions and removals, which can have different operational effects.

Use transaction examples without inventing grandfathering

A purchase contract signed in October 2027 does not automatically exempt a relevant placement or export after 30 December 2027. Contract formation and the regulated commercial event are different questions. Determine the actual activity using the regulation's definitions and the facts. Do not treat a pre-deadline order, advance payment or shipment booking as a universal exemption.

Similarly, goods arriving at a warehouse before the date need a factual assessment rather than an assumed answer. The warehouse location, customs arrangements and prior market activity can matter to identifying the relevant event. Production history may raise a separate question under Article 1(2), but stock purchased in 2027 is not automatically pre-entry-into-force production. Keep those inquiries distinct and record the evidence supporting each conclusion.

Prepare procurement in stages

Begin with classification and feedstock investigation. Identify which catalogue items genuinely match expressly deferred entries and what supplier information is needed. For complex derivatives, a substance's name may not identify whether the relevant commodity was used. Ask suppliers to explain the source relationship before building a compliance process around an unverified assumption.

Next map the evidence path from production through processing to the supplied product. Allocate responsibility for obtaining locations, production periods, legality evidence and the links between input and output batches. Set internal deadlines early enough to resolve gaps and perform risk assessment where required. The later product date provides preparation time; it does not make missing origin evidence easier to reconstruct after release.

Control inventory and release around the date

Assign separate statuses to assessed products, unresolved items and goods awaiting evidence. A stock system should not copy a deferred date from one variant to another merely because both use the same commercial family name. Changes in composition, feedstock or product form may require renewed classification and timing review.

Before the first relevant transaction after application, test a representative product through the complete process. Confirm that the required evidence supports the actual goods and that any required statement or declaration route matches the actor. Technical submission success alone does not prove compliance. Staff also need an escalation route for a disputed classification, changed source or missing production link.

Let the legal entry control the final decision

Use current Annex I and the authentic scope amendment to verify the complete entry, including qualifications, exclusions and the express date. A summary list is useful for screening but cannot replace the precise wording. Not every entry modified in 2026 was newly added or received deferred application.

Record the selected route, source, reviewer and next review trigger. Recheck when legislation changes, a supplier substitutes material or a new entity takes over the activity. After December 2027, maintain ongoing evidence and change controls rather than closing the file as a completed launch project. The deadline is a point from which the relevant obligations apply, not a permanent approval of every future delivery.
