Map legal persons before departments

EUDR group mapping begins with the legal persons carrying out the relevant commercial activities. A parent company's global procurement policy does not itself identify the operator, downstream operator or trader for each Union transaction. Separate subsidiaries can have different roles, and one subsidiary can have several roles across product flows.

Identify the person that first places or exports the relevant product, any manufacturer using covered relevant inputs and later businesses reselling the goods. Then apply Articles 2, 4, 5 and, where relevant, Article 7. Do not assign a statutory role solely to whichever department runs the compliance software.

The EUDR role framework provides the definitions. The current consolidated Regulation is the baseline for deciding who carries the obligation and which shared-service tasks can be performed centrally.

Create an entity and transaction inventory

List each relevant legal entity, establishment, business name and commercial function. Link it to purchasing contracts, invoices, customs arrangements and customer supplies. A group brand or tax reporting unit may not match the person performing the EUDR activity, so use consistent legal identifiers across the record.

Next list relevant product flows between entities and external parties. Include direct imports, domestic production, covered-input processing, unchanged resale and exports. Match products to Annex I scope before assigning a role. A group trading in many materials should avoid extending EUDR controls to every product merely because some stock is covered.

For each flow, capture the supplying and receiving entities, relevant product, processing step, market event and input coverage basis. This creates an auditable explanation of why an entity is an ordinary operator, downstream operator or trader, rather than a chart of departmental responsibilities only.

Apply the cross-border rule to the actual structure

Where a person outside the Union places relevant products on the market, Article 7 deems the first Union-established person making them available to be an operator. A foreign parent selling through an EU distribution subsidiary therefore requires a fact-specific assessment of the subsidiary's activity, not an assumption that the parent absorbs the obligation.

A customs broker or logistics affiliate may provide services without being the commercial supplier. Examine its actual contractual function. Similarly, a central purchasing company may buy for several subsidiaries, but the relevant market events must be identified rather than allocated according to convenience.

Document any uncertainty concerning branches, establishments or agency arrangements. The Article 2(21) establishment definition and actual legal-person facts should support the conclusion. Resolve material uncertainty before release rather than selecting the entity with the easiest Information System account.

Central services can perform work without replacing responsibility

A group compliance centre can maintain supplier evidence, prepare assessments and coordinate submissions. The file should nevertheless identify the operator responsible for the products. Under Article 6, an authorised representative can perform specified submission tasks, while the operator retains responsibility for compliance.

Separate technical access from legal authority. Record who may prepare, approve and submit, the entity on whose behalf they act and any required mandate. A shared login or central document repository is not a substitute for that allocation and can make later authority requests harder to answer.

For Article 5 activities, identify which non-SME downstream operators and traders must register in the Information System. Registration should not be mistaken for an ordinary new statement requirement for every intercompany sale. Keep each entity's role-based instructions visible to the staff using the shared service.

Preserve links through intercompany movements

Intercompany supply can still be commercial making available. Determine whether separate legal persons supply relevant goods and retain the prescribed supplier and business-customer information accordingly. Group ownership alone does not erase the chain or the need to identify the parties.

Where an operator supplies another group entity, Article 4(7) communication and the direct buyer's Article 5(3)(a) reference collection may be relevant. Further along the chain, do not rewrite the targeted reference rule as compulsory universal propagation. Additional group traceability can be maintained as an internal control without misdescribing its legal basis.

Production links also matter. A downstream manufacturing subsidiary needs a supportable basis that all relevant inputs used are covered. Central procurement approval does not prove that a factory's emergency substitute or locally bought input falls within the same coverage.

Assign review and incident ownership

Give each role-map row a business owner, compliance reviewer and review trigger. Corporate reorganisations, new suppliers, changed import routes, new processing operations and changes in size classification should reopen the relevant rows. Preserve earlier versions so historical transactions can be assessed against the structure in place at the time.

Set an incident route that identifies affected entities, products and customers when relevant new information arrives. Apply Article 4 or Article 5 notifications and any pre-supply verification requirements to the correct person. A central team can coordinate communications without assuming that one group's notification automatically satisfies every entity's duty.

The multiple-role business method helps map activities inside each subsidiary. Together, entity and product-flow records give purchasing, production and sales teams a usable instruction while preserving who is legally responsible for each regulated event.

Give local teams access to the rows affecting their transactions. A central legal assessment is much less useful if purchasing and logistics cannot identify the responsible entity when contracts or shipping instructions change.
